On 12/15/2011
the US Department of Labor (DOL) issued a Notice of Proposed Rulemaking (NPRM) that would virtually eliminate the Fair Labor
Standards Act’s (FLSA’s) companion care and live-in exemptions from the FLSA’s minimum wage and overtime
rules.
This proposal
is open for public comment until February 27th, 2012. Please, act NOW!
How would this affect your business?
1. Your live-ins will be restricted to work no more than 3 days per week
2. Need to hire and train more caregivers
3. More potential
unemployment claims due to reduction in hours
4. New record keeping requirements to
document actual hours worked
5. Loss of clients due to extra OT costs
How would this affect your clients?
1. Increase
the number of caregivers
2.
Disruption in the continuity of care
3. Increase the cost of care if able to afford OT
4. Forced to hire individuals privately, thereby exposing themselves to liability risks and potential
abuse.
How would this affect your employees?
1. Reduced wages due to not being able to work over 40 hours
2. Need to seek additional employment
3.
Increase transportation costs since they
need to rotate in/out of clients
