The US Department of Labor is considering changes that would eliminate companion and live-in employee exemptions from minimum wage and overtime rules.
Such a change could be detrimental to your business.

Ask your legislators to say “no” to the proposed changes to the FLSA Companion Care Exemption 
Dear CT Homemaker & Companion Association Member: 
On 12/15/2011 the US Department of Labor (DOL) issued a Notice of Proposed Rulemaking (NPRM) that would virtually eliminate the Fair Labor Standards Act’s (FLSA’s) companion care and live-in exemptions from the FLSA’s minimum wage and overtime rules.
This proposal is open for public comment until February 27th, 2012. Please, act NOW! 
How would this affect your business? 
1.   Your live-ins will be restricted to work no more than 3 days per week
2.   Need to hire and train more caregivers
3. More potential unemployment claims due to reduction in hours
4. New record keeping requirements to document actual hours worked
5. Loss of clients due to extra OT costs 
How would this affect your clients? 
1.      Increase the number of caregivers
2.      Disruption in the continuity of care
3.      Increase the cost of care if able to afford OT
4.      Forced to hire individuals privately, thereby exposing themselves to liability risks and potential abuse.  
How would this affect your employees? 
1.   Reduced wages due to not being able to work over 40 hours
2.   Need to seek additional employment
3.   Increase transportation costs since they need to rotate in/out of clients  
Please, ask your legislators to Support H.R.3066, legislation that clarifies FLSA companion care exemption and prevents DOL from changing definition of companion care. See next page for the ramifications of the proposal.  We thank you in advance and hope that you can take a few minutes to call, write, or e-mail your representative and senators to explain the detrimental effects these proposed changes will have on our older population and our employee caregivers.
